THE CHARTER OF THE GPFO «The Spring of Mercy» 

1. GENERAL RULES

1.1. The Grodno public female organisation «THE SPRING OF MERCY» (further GPFO «THE SPRING OF MERCY») is a voluntary association of the citizens formed on the basis of community of interests to express and protect social, economic and other legitimate interests and rights of the members.

1.2. GPFO «THE SPRING OF MERCY» executes the activity in Grodno according to the present Constitution of the Republic of Belarus, Decree of the President of the Republic of Belarus ¹ 2 from 26.01.1999, Law of the Republic of Belarus «About public associations», other acts of the legislation and the present Charter, Universal Declaration of human rights, Conventions of International Organisation of Labour and other international legal acts ratified by the Republic of Belarus in the established order.

1.3. GPFO «THE SPRING OF MERCY» works on the basis of self-management, does not depend on the bodies of the state authority and management, political, public and religious organisations, has complete organisational, economic and financial independence in realisation of the purposes and tasks of the Charter, it can have the accounts in a bank (and also currency accounts), its seal, stamps, emblem registered in the established order. 

1.4. GPFO «THE SPRING OF MERCY» can join republican and international public associations and organisations, co-operate with other trade-unions and public organisations on the basis of the contracts.

1.5. GPFO «THE SPRING OF MERCY» can use for realisation of the authorised activity electronic and other mass media.

1.11. The juridical address of GPFO «THE SPRING OF MERCY» is 230023, Grodno, Stefan Batory street, 8, room 330. 

2. PURPOSE AND TASKS

2.1. Basic purpose of creation and activity of GPFO «THE SPRING OF MERCY» is the unification of efforts of the members (further members of TUBB) for joint protection and realisation of their rights and legal interests, ensuring of the protection of work, health and other social guarantees.

2.2. Basic tasks of TUBB:

2.2.1. Representation and protection of interests and rights of the members of GPFO «THE SPRING OF MERCY» in courts, bodies of state authority and management, economic bodies;
2.2.2. Rendering free of charge legal and other help to the members of GPFO «THE SPRING OF MERCY» in the established order;

2.2.3. Propaganda of a healthy way of life, strengthening of health realising sports measures, meetings and festivals among members of the organisation and their families; 

2.2.4. Searching for the sponsors to render medical help and treatment of the children - invalids, including abroad;

2.2.5. In the established order obtaining of the humanitarian help and distribution of it among needy families and families where a lot of children are brought up, children - invalids and others who need it;

3. METHODS OF ACTIVITY

3.1. For the decision of authorised tasks and problems GPFO «THE SPRING OF MERCY» uses the following methods of activity according to the present legislation:

3.1.1. Organises and carry out mass measures (lectures, seminars, conferences) to realise and protect legal interests and rights of the members of GPFO «THE SPRING OF MERCY».
3.1.2. Acts as a founder of mass media, is engaged in publishing, in the established order uses mass media to propagate and make popular the purposes and problems.

3.1.3. Organises and carries out meetings, festivals and competitions, participates in spent measures of the republican and international public associations which follow the same purposes and problems, organises exchanges of experience and study, exchanges of delegations.

3.1.4. Carry out other activity which doesn’t contradict to the current legislation

3.1.5. Encourages the sanitation of the members of the organisation, children in the Republic of Belarus and sending them abroad.

Kinds of activity where according to the current legislation the sanction (licence) GPFO «THE SPRING OF MERCY» executes after having obtained the necessary sanction (licence) in the established order.

4. STRUCTURE OF GPFO «THE SPRING OF MERCY» AND ELECTIVE BODIES

4.1. GPFO «THE SPRING OF MERCY» can create clubs, circles on different interests and ways of activity.

4.2 Meeting of GPFO «THE SPRING OF MERCY»:

4.2.1. The supreme body of GPFO «THE SPRING OF MERCY» is the Meeting.
4.2.2. The Meeting is spent as required, but not less than once per two years, on demand of the control-auditing commission, 1/3 members of GPFO «THE SPRING OF MERCY», initiative of the Council of GPFO «THE SPRING OF MERCY».

4.2.3. The decision on date and place of realisation, agenda of General Meeting is accepted by the Council of GPFO «THE SPRING OF MERCY» not later than one month before its realisation.

4.2.4. The assembly is competent, if more than 2/3 of the members of GPFO «THE SPRING OF MERCY» takes part in its work.

4.2.5. Power of the Meeting:

· Determines the directions of the activity of GPFO «THE SPRING OF MERCY».

· Accepts the Charter and brings changes and additions into it.

· Selects Council, the control-auditing commission for the term of no more than three years and asserts their reports.

-Selects the chairman of GPFO «THE SPRING OF MERCY».

-Regards other questions of the activity of GPFO «THE SPRING OF MERCY».

4.2.6. The decisions of the Meeting are accepted by voting. The form of voting is determined in the beginning of its work.

4.2.7. The rules of work are affirmed by the Meeting of GPFO «THE SPRING OF MERCY».

4.3.9. The decisions are accepted:

-on modification and additions into the Charter of GPFO «THE SPRING OF MERCY» - not less than 2/3 votes of those who are present;

-on other questions - majority of votes.

4.3. A Chairman of TUBB:

4.3.1. is selected by the Meeting, by the open voting for the period of 3 years. One of the main claims raised to him is that she should be a mother of a large family who has three or more children under age. 

4.3.2. is reported back to the Meeting of GPFO «THE SPRING OF MERCY», has all rights and powers of the chief of the juridical person, including:

· is in charge of the work of the Council of GPFO «THE SPRING OF MERCY».
- Co-ordinates and organises the work of the Council of GPFO «THE SPRING OF MERCY».

· represents GPFO «THE SPRING OF MERCY» in judicial bodies, in bodies of the state authority and management, in public, governmental, international and republican organisations and bodies.

- carries out other activity according to the present Charter.

4.3.3. For the period of absence or impossibility of execution of the duties by the Chairman of GPFO «THE SPRING OF MERCY», his duties are carried out by the deputy chairman on behalf of the Chairman of GPFO «THE SPRING OF MERCY» or according to the decision of the Council of GPFO «THE SPRING OF MERCY».

4.4. The Council of TUBB:

4.4.1. is a managing body of GPFO «THE SPRING OF MERCY» which works in the period between Meetings, is selected by the Meeting and reports back to it.

4.4.2. develops the basic directions and programme of the activity of GPFO «THE SPRING OF MERCY» and executes the decisions of the Congress.

4.4.3. Joins the citizens to GPFO «THE SPRING OF MERCY».

4.4.4. submits proposals to the appropriate bodies of state authority and management on protection of the rights and legal interests of the members of GPFO «THE SPRING OF MERCY» and other persons.

4.4.5. forms and asserts the budget of GPFO «THE SPRING OF MERCY», disposes of its means and property.

4.4.6. elects the vice-chairmen of TUBB from nominees offered by the Chairman of TUBB.

When the organisation is established the vice-chairman of the Council is elected by the constituent assembly.

4.4.7. considers other questions of the authorised activity of GPFO «THE SPRING OF MERCY». The sessions of the Council are competent, if not less than half of its structure takes part in them. The decisions are accepted by the simple majority of votes. The sessions of the Council are spent as often as required, but not less often than once per month.

4.5. THE Control-Auditing Commission (CAC) OF TUBB:

4.5.1. supervises the activity of elective bodies on execution of the present Charter, expenditure of means, use of property and other activity. The sessions of CAC are spent as often as required, but not less than once per one year.
4.5.2. The quantitative structure of CAC is determined by the Meeting of GPFO «THE SPRING OF MERCY». ÊÐÊ elects the Chairman and secretary from its structure. The activity of CAC is supervised by the chairman.

When the organisation is established the Chairman of CAC is elected by the constituent assembly.

4.5.3. CAC works according to the present Charter.

4.5.4. The requirements of the members of CAC at realisation of the control-auditing activity by them are obligatory for all elective bodies, members of GPFO «THE SPRING OF MERCY».

4.5.5. CAC reports on the Meeting and if necessary informs about results of the activity the Council of the organisation.

4.5.6. The members of CAC can not be elected in other elective bodies, hold posts of the chiefs and main experts in its other structures.

4.6. All solutions of the collegiate bodies are made out by the minutes.

5. MEMBERSHIP IN GPFO «THE SPRING OF MERCY», THEIR RIGHT AND DUTIES OFTHE MEMBERS

5.1. the members of GPFO «THE SPRING OF MERCY» can be girls and women irrespectively of citizenship, place of work or study, in the age of 16, permanently living in the Republic of Belarus, paying dues, following this Charter, participating in achievement of the authorised purposes and problems of GPFO «THE SPRING OF MERCY».

The membership in GPFO «THE SPRING OF MERCY» is fixed. 

5.2. the membership in GPFO «THE SPRING OF MERCY» is established on the basis of the personal written application sent to the organisation and on the basis of the appropriate decision of its managing body.


5.4. The member of TUBB has the right:

5.5.1. to elect and to be elected in all elective bodies when he is 18.

5.4.2. to submit proposals on activity of the organisation and its elective bodies.

5.4.3. to participate in the discussion of questions connected with the activity of GPFO «THE SPRING OF MERCY» and its elective bodies.

5.4.4. to emerge from GPFO «THE SPRING OF MERCY» when he wants.

5.4.5. to participate with the right of a deliberative vote in the work of any elected body of the organisation if the problems concerning his interests are discussed. 
5.4.6. to protect his interests and civil rights by structures and elective bodies of GPFO «THE SPRING OF MERCY».

5.4.7. to receive any information about the activity of the organisation.

5.4.8. to get free-of-charge advice on legal questions.

5.4.9. to use the property of GPFO «THE SPRING OF MERCY», privileges and services given to the members of GPFO «THE SPRING OF MERCY» in an established order.

5.4.10. to use other rights mentioned in this Charter 

5.5. The member of TUBB is obliged:
5.5.1. To fulfil the requirements of the Charter, to solve problems of GPFO «THE SPRING OF MERCY» 

5.5.2. To propagate purposes and problems of GPFO «THE SPRING OF MERCY», to execute practical fulfilment of all solutions of the Meeting of the council of GPFO «THE SPRING OF MERCY».

5.5.3. to attend meetings and to participate in their work and work of elective bodies, being elected in them.

5.5.4. to pay dues in time.

5.5.5. not to interfere with the execution of the accepted decision when he doesn’t agree with the decision of the majority and he shouldn’t vote against the acceptance of such decision.5.6.2. to propagate the purposes and tasks of TUBB.

5.5.6. not to permit actions which bring harm to the authority of TUBB.

5.6. when he fails to fulfil his duties he can be excluded by the decision of the Council.

5.7. the left or excluded from GPFO «THE SPRING OF MERCY» has no right on the property of TUBB.
6. MEANS AND PROPERTY OF TUBB

6.1. GPFO «THE SPRING OF MERCY» according to the authorised purposes and problems can have of buildings, facility, equipment, stock, vehicles, property of cultural and educational and sports assigning, money resources in the property and diverse property which is necessary for financial security of the authorised activity except for objects which according to the law can to be only in the property of the state. 

6.1. the means and money resources of the organisation are formed from dues and target payments, property which was inherited, gifts and donations, sponsor's help of the citizens and organisations of the Republic of Belarus and other countries, publishing, delivering of lectures, organisation of competitions, other receipts which are not forbidden by the legislation. 
6.3. The solutions on acquisition, order and disposal of the property are received bythe Council.
6.4. The monthly dues are 1 % from a minimum wage established in the Republic of Belarus.
7. OFFICE-WORK:

7.1. the office-work of GPFO «THE SPRING OF MERCY» is conducted according to the current legislation in an established order.

7.2. the documents on the personal staff are handed over into the archive by a place of the location of the juridical address of the organisation.

8. DISCONTINUANCE OF ACTIVITY OF GPFO «THE SPRING OF MERCY»:

8.1. the activity of GPFO «THE SPRING OF MERCY» can be stopped by the decision of the Meeting, if not less than three quarters of the members of those members who are present vote for this decision or by the decision of the court in cases stipulated by the law.

8.2. When the activity of GPFO «THE SPRING OF MERCY» is discontinued the property and the means which are left after satisfaction of all requirements of the creditors are directed on the charitable purposes and purposes stipulated by the Charter. 

8.4. About the liquidation of GPFO «THE SPRING OF MERCY» they inform in official mass media, the registering body, tax bodies, the bank and in the DAIA in a place of the sanction on distribution of a seal.
